The Martrydom of Saint Kevin

For over a week some of us have been laughing and shaking our heads over the missives that jailed serial scammer Kevin Trudeau is supposedly posting on his "official" Facebook page -- messages that gush on and on about what an amazingly wonderful experience it is for him to be in the slammer. In one of his latest missives we see that the hoosegow is kinda like being at an ashram or retreat. Writes Kevin the aspiring monk, from his cell on November 26, 2013 (psst! it's really just one (or more) of his minions writing this dreck):
For years I had wanted the opportunity to go to an "ashram" or monastery, or some kind of "retreat", where I could be alone and contemplate, think, reflect, meditate, exercise, and be totally removed from society. I am enjoying my time today doing just that! WOW! You do get in life what you ask for! I am so blessed and happy. Think of your life. You are in fact living the life you created. Make the most of it or change it and create the life you want. Remember, everyday you and you alone can make the decision to be happy and have a great day no matter what the circumstances appear. Life is truly exciting and wonderful!

Be careful what you wish for, Kev...

I wonder how many people honestly believe Kevin is having a marvelous time behind bars. Kevin's brother Bob certainly has a different story to tell; on more than one occasion on Facebook he has talked about his brother's past incarceration experience, and how it almost destroyed their mother whenever the family went to visit Kevin in prison. I feel so bad for Kevin's parents, who definitely seem to be examples of collateral damage.

But never mind those dear old people; the spin must go on. And the martyr's legend is being kept alive on a page from which I have been blocked for some reason I haven't yet figured out: the GIN International Page. Fortunately a friend of mine can still get there, and that friend sent me some screen shots of a convo that took place last week, around the time that the jailhouse crock began.





This bit, from a commenter named Jean-Marc Jacot, is particularly amusing:

...the Feds are turning KT into a living Legend, the archetype of a Martyr fighting and thus persecuted for Truth and Justice, of the same dimension as Henry David Thoreau, Mahatma Gandhi, Martin Luther King, Nelson Mandela!
Katie is going to have to fight a few other folks for fake-Gandhi rights. At any rate, as we know, Kevin has been grooming that martyr image for years, and now it's just a self-perpetuating motif that has taken on a life of its own.

Also noteworthy is that
Fred Van Liew, aka Fred van Loony, long time friend of Kevin Trudeau (and by the way, brother Bob shared on Facebook that their parents never liked Freddy) is doing his part to keep that martyr legend alive, and is striving to rally the troops for a "peaceful" war. Fred, as reported here recently, was at one point planning to go on that "alternative" GIN cruise that some of the minions are planning, but later backed out. It appears that these days, Freddy is kind of allying himself with some of the scavengers who want to wrest control of Trudeau's massive scam, the Global Information Network, or GIN, from the court-appointed receivers.

Apropos of that, I hadn't been to PACER in a few days but visited again yesterday and saw that a couple more docs were filed after my last visit on November 21. Two documents, Document 802 and 803, filed on November 21 and 22 respectively, indicate that the receiver is getting paid (per their request) and that the "Intervenors'" case, led by Ohio GIN member Perry Kiraly, is going to be heard.

I am actually surprised that the court didn't just throw out the whole motion to intervene, but the docs filed a few days ago seem to verify what Kiraly's
Stand With GIN updates are saying: the court has indeed approved the Shimko brothers to represent Perry Kiraly et al. (the "Intervenors"). Response to motion to intervene is due by December 20, reply to that response is due by January 7, and another status hearing is set for January 30. And as indicated above, the receiver's motion to approve fees was granted.

Whether or not the Shimkos were treated as respectfully by the court and the receiver as the Stand With GIN update indicates, I couldn't tell you. It's hard to tell what is really going on. Sometimes, as we know, attorneys put spins on things for their clients, and sometimes, as we also know, those clients spin things for their followers. All I have seen besides Kiraly's updates are the rudimentary court docs available on PACER. They are very neutral.

In any case it seems that the "Intervenors" are still holding out hope that if they cannot make a case for member ownership of GIN, they can get first dibs when and if it goes up for auction, but preferably they would like to make an arrangement to purchase it outright. To many of us this may seem patently absurd, and some of the "GIN Destroyer" contingent are guffawing about it on their Facebook forums, but in the right (or wrong, depending on your perspective) hands the intellectual property could theoretically be worth a pretty penny in Scamworld.

And it seems clear that Perry and gang have a "vision" for what GIN could be. This part caught my eye, though:

[Our vision is] of a club so in-ethics and in possession of that which enables one to makes their dreams come true, that those that find out about us will be knocking on our door at 6am to get you to sponsor them in.
"In-ethics" is a Scientology phrase. Just thought I would mention that. But it seems that Yon Vetter Cole, a long-winded fellow who is also in on the Intervenors case, is pretty deeply into Scientology, so maybe that explains some of the language. (Trudeau has promoted Scientology and Dianetics too.) Yon, who is into all kinds of New-Wagey things, and is the founder of the Your Wish Foundation (not to be confused with the Make A Wish Foundation) has lofty visions for GIN, as he shared in a protracted convo on the GIN International Facebook page on November 19, 2013:
Rarely have there been the spiritual giants who are called to serve millions in their lifetime. The love from source absolutely radiates through GIN, but what is coming in the future, the radiance and magnificence that are being prepared to emerge... are unlike anything the world has ever seen. The monetary platform in GIN brings in certain kinds of people, and the membership levels, especially 2-6, prepare their hearts to discover whole new dimensions of love. This combination and the scale of GIN's mission/vision are unlike anything this world has ever scene [sic] before.

Oh my goodness, I hear the heavenly harps playing now. I see the pure golden light emanating from Saint Kevin Mark Trudeau. Or maybe I am supposed to be seeing that golden stream coming from some of Kev's good and faithful serpents...I mean SERVANTS... who surely are spiritual giants in the making. Anyway, I am pretty sure I see something streaming from somewhere. And lo, my heart is full, and I am at peace.

But anyway. I am no legal expert, as may be obvious. But after going through hundreds of pages of legal documents I do not think the Intervenors have a legitimate case regarding the ownership of GIN. It seems so obvious that despite the convoluted structure -- deliberately set up by Trudeau and Marc Lane years ago --  it is a Kevin Trudeau asset..

However, the receiver and the court could possibly decide that despite any huge earnings in the past, GIN will never be a viable source of funds to pay towards Kevin's humongous FTC fine -- and they may decide to sell the rights (i.e., the intellectual property, including the name) to the Intervenors or some other group of scavengers, just to get it out of their hair.

So it is possible that GIN may live on under the auspices of
lesser crooks and maybe a Scientologist or two. And if they happen to be Katie fans they can keep his legacy alive -- yes, even if he stays in the joint... er... ashram -- as a martyr who is rockin' the orange on behalf of freedom and justice for all.

PS ~ Saint Kevin is not the first martyr to appear on this Whirled. Anyone remember Aussie investment "expert" David Schirmer, the "car park, cheque's in the mail" guy in The Secret? He earned his sainthood by being exposed on an Aussie TV show as a scammer. He even likened himself to Saint Stephen. Eventually he got banned for life from working in theinvestment industry in Oz. Actually, come to think of it, just about every New-Wage sociopath I've covered here has at some point played the martyr card. That's always Plan B, when trouble knocks on the door, as it almost invariably does.

Kevin Trudeau: Slammer overkill, and a chance for Loony Coldwell to eat his words (though he probably won't)

 
This isn't your ordinary scammer-in-the-slammer tale. As most who are following this case know by now, serial scammer Kevin Trudeau got a double whammy after Judge Robert Gettleman signed an order November 21 to incarcerate Katie in the matter of his civil contempt charge. Judge Gettleman snarkily noted that if the court-appointed receivers want to talk to Katie some more about his hidden assets, "they'll know where to find him."

Now, to some this "second incarceration" may seem like overkill. After all, Trudeau is already in custody awaiting sentencing after
being convicted of criminal contempt on November 12, in the court of Judge Ronald Guzman. So now he is being held on two separate cases, the civil and the criminal. To slightly misquote an old saying, "If I were any worse, there'd have to be two of me." But there's only one Kevin to do jail time for both offenses.

It appears that the almost endlessly patient Judge Gettleman finally grew tired of dealing with Katie after years and years and years of hearing the latter's excuses. Moreover, his order clearly states that this incarceration is a separate matter and that the time spent in custody for the civil case will not cut any time from the criminal sentence, whatever that may be. (Currently, sentencing for the criminal conviction is scheduled for February 6, 2014.)

For all practical purposes the order cages Katie indefinitely -- until and unless he can purge himself of the civil contempt matter by either paying the $37.6 million fine or by convincing the court that he honestly does not have the funds to do so. The latter scenario -- True-dough convincing the powers-that-be that he is truly OUT of dough -- appears increasingly unlikely. Judge Gettleman noted that Trudeau has been caught in several lies already and that there's no more reason NOT to incarcerate him to force cooperation with the receiver. Previously the judge gave Katie a little leeway so he could prepare for his criminal trial. The judge agreed with Katie's attorneys that this could probably be done more efficiently with Katie out of the clink.

But that trial has come and gone, so that reasoning won't fly anymore.

No doubt other matters were discussed at the November 21 hearing. After all, that was the day that the receiver was supposed to present a big invoice to the court, and the day that Katie's fairly-recently appointed tax attorneys were supposed to appear and tell the court that the receiver had not been cooperating in giving Katie access to records he needs in order to prepare for an upcoming reaming by the IRS.

And then there's the matter of The Intervenors:
Ohio GIN member Perry Kiraly and a couple dozen other folks who are trying to hold up the civil case stagecoach and wrest ownership of the remains of GIN from the court or the receiver or whomever. Presumably Perry's part of the case will at least be discussed in the court (either in open court or otherwise) before it gets summarily dismissed. And then there's the matter of another threatened lawsuit by the Loony Lenny Coldwell contingent, another effort to squeeze every drop of money from GIN before it gets shut down totally. I wrote about some of that on this recent blog post. In short, there are vultures and hyenas circling all about the twitching remains of the Global Information Network.

Anyway, I'll have info on additional court papers as soon as they show up.

For now, Kevin Trudeau is indisputably in a cage, and there's no telling when he will get out. He still has scads of fans and supporters, and judging from some of the comments on Facebook, a few of them haven't been following the news very well and are shocked that he's behind bars. A few of his minions are posting
sappy gunk to the "official" Kevin Trudeau Facebook page, in order to keep the troops encouraged (and perhaps to lay the groundwork for Katie's next scam).

Some say that Trudeau's exceedingly loyal longtime friend, business partner,
fellow litigant and ex-girlfriend Janine Nubani Contursi is writing the posts, which contain numerous spelling errors and are variations on the same theme: All is well, this is an amazing experience for Trudeau, and he will emerge from the slammer stronger than ever. Whoever is writing them (it almost certainly is not Katie himself), it's all crap, of course -- at least the "all is well" part, because word has it that being in jail, particularly if you don't know when you'll ever get out, sucks no matter how you slice it. And I suspect that even Kevin's most devoted and gullible fans know at some level that he wishes he were just about anywhere except the slammer.

Once again I'll say that I don't think caging a scammer like Trudeau = justice. In general, I simply don't like the idea of caging someone who is not a violent offender (and in the category of "violent offenders" I include serial sex offenders such as some ex-KT b.f.f.s are alleged to be). But for better or for worse, throwing Trudeau into jail is within the law.

The big burning question I have is this: Will Loony Lenny Coldwell, Katie's ex b.f.f. and GIN's former alt-health spokes-liar, have to eat the words
he spewed out this past September when Judge Gettleman failed to incarcerate Katie and refused to shut down GIN on that very day? Has Loony changed his mind about the judge being (a) corrupt and paid off; (b) old and incompetent; (c) afraid; (d) gay with the hots for Kevin Trudeau; or (e) all of the above?

Loony isn't much for eating his own words, and I've never known him to admit he was wrong about anything. The only thing of which we can be certain is that he will continue to milk these latest developments by trying to pull more people into his IMBS-ing U Master Baiter's scam (for "anti-brainwashing" sessions), and trying to get people to come to his idiotic party in Florida in December. (Already the event is free for pretty much anyone who wants to show up.)

But the little man's efforts will be mostly in vain, for Loony will almost certainly never enjoy anything remotely like the level of devotion and loyalty that Kevin Trudeau -- however misguided many of us may think the True-doughnuts are -- has managed to earn over the years. And if by some miracle of legal and poetic justice Loony gets thrown in the slammer himself one day, I doubt that many people will weep the way they are now surely weeping (despite those all-is-well Facebook posts) for Kevin Trudeau.

    Kevin Trudeau: caged for now?

    It's cage-a vu all over again for Kevin Trudeau,
    but it seems he hasn't run out of options -- yet.

    [NOTE: See update at the end of this article. Spoiler alert (in the unlikely event that you hadn't heard): Katie is out of the clink for now. ~CC]

    According to NBC5 Chicago, reporting earlier today, Judge Robert Gettleman has ordered serial scammer Kevin Trudeau to go to jail -- at least long enough to meet with the receiver and finally reveal everything about his finances. There was a bit of a flap the other day about that whole financial-revelation issue, as the receiver revealed that Katie was still trying to live large, and was playing around with a bank account in Australia.
     

    The NBC story reports that Judge Gettleman let Katie know that this is real life, not an infomercial, and Katie can't talk his way out of this one. Judge Gettleman says he now regrets not sending Katie to the clink earlier.
     

    A follow-up hearing is scheduled for tomorrow, Thursday, September 19.

    Here is Judge Gettleman's order to incarcerate Trudeau until someone can shake money and/or info out of him.

    As many may recall,
    this same judge ordered Katie to jail back in 2010, during that contempt issue stemming from a deluge of letters Katie's supporters sent to the judge. Kevin was able to talk his way out of that one, or at least his lawyers were. But the stakes are higher and the issues a bit more serious this time. And the judge has clearly run out of patience. After all, he has been dealing with Kevin's shenanigans for many years now. (Here's more about Judge Gettleman and his general background.)

    Even so, don't count Katie out yet. He may not actually be in a jail cell right now at this very moment. According to today's court order, he will be a guest at Chicago's
    Metropolitan Correctional Center (aka the MCC), at least until his hearing at 11:00 AM on the 19th. The MCC has been home to several "notable inmates," according to Wiki.

    Judging by what the court order said, he will be in custody at least overnight.

    "3. The court directs the United States’ Marshal Service to take defendant Kevin Trudeau into custody and to hold him until further order of the court, which will be entered tomorrow, September 19, 2013, at a hearing scheduled to begin at 11:00 a.m. The Marshal and the Metropolitan Correctional Center are directed to ensure that Mr. Trudeau is available to be interviewed by a representative of the Receiver and its attorney, along with access to defendant’s counsel, to allow defendant to demonstrate that he has or can purge himself of his contempt."

    Now, I suppose that "custody" could mean anything. Maybe the Marshal is a member of Kevin's fabled Brotherhood and will usher him down to a seekrit subterranean luxury bunker where he can continue to enjoy fine cigars and booze and an organic banquet and manicures and pedicures out of sight of the general public. Or maybe the Marshal and Kevin will go out on the town together, with Kevin handcuffed to him. That would still be custody, technically speaking. *

    At any rate, I just checked the "Inmate search" on the MCC web site and as of the time I am writing this (7:20 PM CDT, Wednesday, September 18), Trudeau hasn't been processed through the system. There was nothing for "Kevin Mark Trudeau," so I tried "Kevin Trudeau," and the only record was the one from Katie's past incarceration in the 1990s. Here's a close-up:

    The Schadenfreude is so thick you can cut it with a knife on some of the Facebook forums, and the jokes about Kevin and his burly cellmate Bubba are flying back and forth among the ignoranti. But even if Kevin does end up in a cell, the big priority will presumably be for him to meet with the representative from the receiver, Kenton Johnson, to discuss his finances -- not to be thrown into the general population and degraded, as some of his detractors seem to want so badly to happen.

    Understand that I'm not defending anything Kevin Trudeau has done; I've been writing for years about what a con artist and liar and sociopath he is. But those of you who are salivating over the prospect of Kevin and "Bubba" need to consider that
    some of those who have been crowing the most loudly about this are much more deserving of "Bubba's" attention than Kevin is.

    * As people who have read or listened to Kevin may know, he has bragged that when he spent time in the Federal lockup in the early 1990s, it was indeed Club Fed and really quite cushy, because (or so he claimed) he had connections with his secret "Brotherhood" members who saw to it that he was treated like a king. A big part of his marketing shtick for the GIN scam was that he still had these kinds of connections and seekrit knowledge, and anyone who was willing to invest money in GIN could eventually acquire that knowledge and even those connections too. And many people apparently believed it. His brother Bob has told quite a different story of Kevin's prison experience, and particularly of how awful the experience was on Kevin's parents.

    I didn't feel like writing a whole new blog post about this so I'll just update this one. Judge Gettleman agreed to release Katie again, with a warning.

    A judge agreed to free TV pitchman Kevin Trudeau from custody today, but warned that he would throw him back into jail if he does not cooperate with federal regulators looking into his financial affairs.

    "I'm going to release you today," U.S. District Judge Robert Gettleman told Trudeau, dressed in an orange jumpsuit after spending a night at the Metropolitan Correctional Center. "If I'm not satisfied that you've been forthright with them, you might be wearing the same color you're wearing right now."


    The judge set another hearing for Sept. 26.

One point to note is that so far the FTC has not had its wish granted regarding its demand to have Katie's monthly allowance taken away unless he gets a real job and contributes to the receivership estate.     Kevin Trudeau: the receiver finds some plunder Down Under, FTC not pleased, nudges judge to jail Katie

    This past Friday (September 13, 2013), I reported on the September 12 response by serial scammer Kevin Trudeau's lawyers to the Federal Trade Commission (FTC) motion for a modification of the August 7 receivership order. The FTC wanted the court to take Kevin's modest (by his standards) monthly living allowance away unless he gets a real job and earns his keep. Kevin's attorneys lamented that Katie is just a poor boy and he needs that allowance, darn it, and besides, he is unemployable because he's a convicted felon and all that. Here's the scoop on that, if you need to catch up. (That post also contains links, at the end, to all of my previous posts on Trudeau.)

    Today, September 16, was the day that the FTC's reply to Trudeau's lawyers' response was due.
    And boy, did the FTC give the court an earful (or an eyeful). They are not-so-subtly nudging the judge to throw Katie in jail for, among other things, the fact that Katie has an account in Australia that he forgot to disclose to the receiver. Oops! 

    (As it happens, he did mention its existence to the FTC back in January 2013, but gave no information beyond that; see PS below. At best his handling of the account in re the Feds and the receiver seems like a fib by omission.)
     
    I'm not all that surprised by the assets Down Under. Katie has roots in Oz, having done business there with, among others, the late lamented Rene Rivkin. They were good buddies before Rivkin killed himself in 2005. I have a half-finished blog post about that very topic. I need to finish it.

    Anyway. Katie has not exactly been living like a poor boy since his assets were frozen. In fact, he has been living large. According to today's document:

    As the Court will recall, on July 26, the Court sternly warned Trudeau regarding what would happen if he did not comply with the receivership and asset freeze. As the Court put it, 'I would be absolutely within reason and the law and the facts of this case to incarcerate [you] today,' PXA:3 at 30:20-22, but the Court wanted to give Trudeau a chance to cooperate with a receivership. However, if that 'doesn’t work,' then incarceration 'will be the next thing that happens.' Id. at 31:8. As the Court explained to Trudeau, 'instead of putting you in prison, or incarcerating you, I’m giving you the key to open that [jailhouse] door. I’m giving you the key to keep you out of that door. And it’s the last time I am going to do that.' Id. at 40:17-20.

    The next day, July 27, Trudeau spent $185 at the Dalia Salon & Spa in Hinsdale. See PXA:2 at 3; see also www.salon-spadalia dot com. And the following day (July 28), Trudeau spent $357.21 at Whole Foods in Hinsdale, $559.52 on cigars in Westmont, and transferred 20,000 Australian dollars (approximately $18,642) from his Australian account to an unknown location.

    Grouses the FTC, "The Australian account is almost certainly not the only source of funds that Trudeau is using to maintain his lifestyle. It is merely the only one for which the Receiver has obtained statements thus far."

    It should be noted that the receivership order did not go into effect until August 7, and some of Katie's livin'-large expenditures were incurred before then. Even so, his assets were technically frozen on July 26, so...

    At any rate, here is what the FTC wants:

    Although the Court may elect to incarcerate Trudeau now (and the FTC reserves the right to seek such relief in the future), the FTC asks the Court to:
    (1) modify the Writ Ne Exeat (June 25, 2013) (DE699) to prevent Trudeau from leaving the Northern District of Illinois until he: (A) repays everything he spent in violation of the Court’s orders ($8,679.43);7 (B) disgorges the remaining balance in his Australian bank account to the Receiver; and (C) provides the $18,642 that he transferred from that account on July 28 to the Receiver; and
    (2) modify the Receivership Order to clarify that Trudeau may only receive money for 'ordinary and necessary' living expenses from amounts he contributes to the Receivership Estate through legitimate employment.

    All righty, then! There are numerous other tidbits in that document. We learn, among other things, that Kevin's lovely bride Nataliya Babenko has returned to Ukraine (footnote 6, page 5 of document 749). I am crushed, for I had such high hopes for that marriage. If a serial scammer and his young mail-order bride can't make a go of a marriage, is there any hope for the rest of us? The FTC makes note of this because the formerly approved allowance for Katie was for two adults, one of whom was presumably his wife. But now she's no longer living with him (and actually has not been for months), so the FTC is also suggesting that his paltry allowance should be made even more paltry.

    So... will Katie finally end up in jail, at least until he can scare up some money that the FTC and the receiver are satisfied does not belong to the receivership estate? Or will the judge decide again not to incarcerate Katie, leaving him open to accusations of running a...um... kangaroo court? Stay tuned.

    PS ~ Here is another court document that was filed later on September 16, 2013. This is the receiver's supplemental report (Document number 750, and attached exhibits, comprising Document 750-1). The report covers items discovered or clarified since the receiver's first monthly report (September 6, 2013). Some of these exhibits were also attached to Document 749, linked to above. If you read the document you will see that the receiver (footnote 2, page 1) says Kevin did apparently alert the FTC to the existence of the Australian account back in January of 2013 during his financial disclosures, but the FTC said they did not have any info beyond that at the time. Also, after the receiver began the investigation, they confronted Kevin with questions about the account, and at first he said he had no access to it, but later he provided access. Kevin will probably try to argue that he was NOT concealing the existence of this account, which technically is true. However, it also seems that the investigators had to coerce him to give them the details, and that he lied to them a few times in the process.
